SUGARBUN APP AGREEMENT

  1. BEFORE USING ANY SERVICES ON THIS PLATFORM, please read and agree on the following Terms and Conditions:
  2. INTELLECTUAL PROPERTY
    1. All trademarks, logos and images, including these Terms as displayed on the Platforms or in our marketing materials, whether registered or unregistered, are the intellectual property of SugarBun (and it’s holdings company/associates). You may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify these Trademarks in any way without our prior written consent.
  3. DEFINITIONS
    1. "Agreement" is a reference to these Terms and Conditions, the Privacy Policy, the Cancellation and Refund Policy, and any order form and payment instructions provided to you;
    2. "you", "your" and "yours" are references to you, the person accessing this Platform; and the person ordering any Goods or Services from the Platform or from any other channel provided by SUGARBUN APP;
    3. "we", "us", "our", and "SUGARBUN APP" are references to the Company, SB Supplies & Logistics Sdn. Bhd., Company No. 198401014464 (127020-V);
    4. "Platform" is a reference to our App, SUGARBUN APP (iOS/Android) or our Website https://www.ordersugarbun.com.my;
    5. "Goods" is a reference to any perishable and non-perishable goods which we may offer for sale on our Platform;
    6. "Service" or "Services" is a reference to any service which we may provide via our Platform;
    7. "“Order”" is a reference to any order you place via our Platform;
    8. "Delivery" is a reference to any form of delivery service provided by us.
  4. USERS UNDER 18
    1. Users below the age of 18 must obtain consent from parent(s) or legal guardian(s). If you accept these Terms your parent(s) or legal guardian(s) are deemed to be responsible for your actions and for all or any charges associated with your use of the Platform and/or your purchase of the respective Goods. If you do not have consent from your parent(s) or legal guardian(s), you must stop using/accessing the Platform immediately.
  5. USER’S DETAILS
    1. Once you place an Order through our Platform, you are deemed to have agreed to provide us with your details and you further warrant that these details are accurate and complete at the time of ordering. To ensure that your Order(s) arrive at the correct location do provide an accurate address and telephone number.
    2. When using this Platform you are required to provide your mobile phone number, e-mail address and password. Please ensure that these details are secure and do not provide this information to any third party. Our SUGARBUN APP personnel will NEVER and will NOT ask for your password at any time/under any circumstances.
  6. USER’S OWN USE
    1. You are deemed to have warranted that the Goods and Services purchased from this Platform are intended and shall be for your own use only and not for resale.
  7. PRICE OF GOODS
    1. The price of Goods listed on our Platform may be subject to/ include SST where applicable. All prices are in Ringgit Malaysia (RM).
    2. The price of Goods are fixed price and as per what is shown on the Platform at the time of publication. We however reserve the right to change all or any of the said prices at any time without prior notice.
    3. All delivery fees, handling fees or prices in relation to the goods and services as shown in the App are subject to change without prior notice at the discretion of the Company.
  8. DELIVERY DETAILS
    1. When your Order is confirmed there will be a confirmation message specifying delivery details which include the approximate delivery time, the price of the Food, Meals and Services ordered.
  9. DELIVERY FEE
    1. A Delivery Fee shall be chargeable by SUGARBUN APP, which will be shown separately before your order is confirmed. The said Delivery Fee is determined by the distance between you and our outlet’s location.
  10. DELIVERY FROM VARIOUS OUTLETS
    1. Our Goods may be delivered from any of the several Outlets located in specific delivery areas. By entering your delivery address on the Platform, you will see the Outlets that are available to you at that particular time. Delivery areas may expand, shrink or change depending on weather and traffic conditions and situations of force majeure.
  11. MODIFICATION OR CANCELATION OF ORDER
    1. After you have placed your Order and in the event the Goods you ordered for is not available at the time of your Order, our outlet will contact and notify you accordingly; in which regard you may cancel or modify your Order.
    2. In the event of a cancellation, we will refund any payment that you have made.
    3. Should you opt to modify your Order, the transaction will proceed.
  12. DROP OFF POINT
    1. We reserve the right to deliver the Goods you ordered for to the Drop Off Point indicated/designated in the application; and to leave the premises after 5 minutes in the event we do NOT receive any reply/response to our telephonic correspondences. We will not be liable for all or any losses/damages whatsoever suffered/incurred by you due to your omission to accept delivery at the given time of the Goods ordered by you.
  13. CONSUMPTION OF GOODS WITHIN ONE HOUR
    1. In the case of the delivery of food and drinks it is our assumption, for all intent and purposes, that you will consume the said Goods within one (1) hour from the time of delivery. Delivery of your food shall be deemed completed in the following circumstances:
      1. when you are deemed to have picked up your Order from any designated location; or
      2. in the case of a Dine-In, when you have been served with your order; or
      3. when you are deemed to have duly accepted delivery of the Goods when your Order was delivered to the address given by you.
  14. MENUS
    1. The list of dishes (and the list of ingredients thereto) on our menus are not an exhaustive list.
  15. ALLERGENS
    1. Dishes may contain traces of allergens such as nuts, meats, wheat, soya, rice, sulphites or seafood.
  16. OFFERS & PROMOTIONS
    1. For all Orders where a Promotion, Offer Code or Discount code has been applied, payment must be by Cash, Bank EFT or Eftpos/Credit Card.
    2. No other Reward or Discount* Apps can be used to pay for an Order where a discount or offer has already been applied/given by us.
  17. E-NEWSLETTER
    1. By registering in this app, your contact details (email, birthday, phone number) will be automatically subscribed to our e-newsletter for internal marketing purposes. Your privacy is important to us. We will not be sharing your information with any third party entities.
  18. REFUNDS
    1. Refunds may be issued at our discretion and can be either partial or whole depending on the circumstances.
    2. Refunds will not be given for making the wrong Order or choice
    3. If you believe your Order was not as advertised, please contact us and we will endeavour to resolve the matter/issue.
    4. A refund will generally take three (3) to five (5) business days. HOWEVER if your mode of payment for your Order was via credit- card, refunds can take up to two (2) weeks to process.
  19. UNAUTHORIZED ACCESS TO YOUR DATA
    1. You are to ensure that the credit or debit card details that you provided are your own credit or debit card. The details of your order and payment shall be kept secret/secured.
    2. In the absence of negligence on our part we cannot/shall not be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Platform.
  20. NO LIABILITY FOR LOSS/ RELIEVE FROM LIABILITY
    1. The services we provide are for private and/or domestic consumption/use only.
    2. We shall NOT be liable for any indirect loss, consequential loss, loss of data, loss of income or profit, damage to property and/or claims of/from third parties arising out of or from the use of the Platform; or from the use/consumption of any products or services purchased from us.
    3. We shall NOT be liable in any way whatsoever for any loss or damage arising:
      1. from your use of information from any third party; or
      2. from your consumption of any Goods from any Merchant; or
      3. from your usage of any third-party Platforms;
  21. THIRD PARTY LINKS AND WEBSITES
    1. Our Platform may contain links to other third-party websites and by clicking on these links, you agree to do so at your own risk. SUGARBUN APP does not control or endorse these third-party websites or links and shall not be responsible for the content of these linked pages. SUGARBUN APP accepts no liability or responsibility for any loss or damage which may be suffered by you in relation to your access and use of these third-party links and websites.
  22. AGREEMENT GOVERNED BY LAWS OF MALAYSIA
    1. These Terms and Conditions and our Agreement shall be governed by and construed in accordance with the laws of Malaysia. The parties hereto submit to the exclusive jurisdiction of the courts of Malaysia.
    2. No delay or failure on our part to enforce our rights or remedies under the Agreement shall constitute a waiver on our part of such rights or remedies unless such waiver is confirmed in writing.
    3. All dealings, correspondence and contacts between us shall be made or conducted in the English language.
    4. SUGARBUN APP reserves the right to change or modify these Terms (including our policies which are incorporated into these Terms) at any time. You are strongly recommended to read these Terms regularly. You will be deemed to have agreed to the amended Terms, if any, by your continued use of the Platform.
